1. Acceptance of Terms

By accessing or using HYBRID Coach ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

2. Description of Service

HYBRID Coach is a fitness coaching platform that connects athletes with certified coaches. The Service includes:

• Personalized workout programs
• Progress tracking and analytics
• Communication between athletes and coaches
• Community features and challenges
• Video analysis tools

3. User Accounts

To use certain features of the Service, you must create an account. You are responsible for:

• Providing accurate and complete registration information
• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

4. User Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Harass, abuse, or harm other users
• Share inappropriate, offensive, or illegal content
• Impersonate others or misrepresent your identity
• Attempt to gain unauthorized access to the Service
• Interfere with the proper functioning of the Service

5. Coach Responsibilities

If you use the Service as a coach, you additionally agree to:

• Provide accurate information about your qualifications and experience
• Deliver coaching services professionally and in good faith
• Respect athlete privacy and confidentiality
• Comply with all applicable laws and regulations
• Not provide medical advice unless properly licensed

6. Payment Terms

Coaching services are subject to the following payment terms:

• Subscription fees are charged monthly in advance
• All payments are processed through Stripe
• Refunds are subject to individual coach policies
• We reserve the right to change pricing with 30 days notice

7. Intellectual Property

The Service and its original content, features, and functionality are owned by HYBRID Coach and are protected by international copyright, trademark, and other intellectual property laws.

8. User Content

You retain ownership of content you create on the Service. By posting content, you grant us a non-exclusive, worldwide license to use, display, and distribute that content in connection with the Service.

9. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, secure, or error-free. Fitness advice provided through the Service is for informational purposes only and should not replace professional medical advice.

10. Limitation of Liability

To the maximum extent permitted by law, HYBRID Coach shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.

11. Termination

We may terminate or suspend your account at any time for violations of these Terms. Upon termination, your right to use the Service will immediately cease.

12. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and the Federal Republic of Germany, without regard to conflict of law provisions.
